Child Support Obligations in Texas

The Texas Family Code provides general determining factors or "guidelines" for child support obligations for people whose net resources are below $8,550 per month. Note that "net resources" is not necessarily the person's take-home pay. For instance, what a person contributes to a retirement account, even though it comes out of his or her gross income, is not considered in arriving at a person's net resources for the purposes of calculating child support. In addition, the obligor is generally required to provide health insurance for the child. For persons whose net resources are below $8,550 per month, child support is generally based on:

  • 1 child - 20% of net monthly resources
  • 2 children - 25% of net monthly resources
  • 3 children - 30% of net monthly resources
  • 4 children - 35% of net monthly resources
  • 5 children - 40% of net monthly resources
  • 6 or more children - Not less than 40% of net monthly resources

These percentages vary if the person who pays child support also pays support for other children from a different relationship or is the custodial parent of children from a different relationship.
